Understanding the Massachusetts Probate Process

In Massachusetts, probate begins when a petition is filed with the Probate and Family Court. The court then appoints a personal representative (formerly an executor or administrator) to manage the estate. 

This individual is responsible for identifying and valuing estate assets, notifying creditors, paying debts and taxes, and distributing the remaining property according to the will—or, if no will exists, per Massachusetts intestacy laws.
