Expert Advice for Your Safety and Well-being

Navigating the process of obtaining restraining orders can be complex and overwhelming. At the Schaefer Law, we understand the importance of your safety and well-being when facing threatening or abusive situations.

What Is A Restraining Order?

A restraining order, also known as an order of protection or injunction, is a legal document issued by a court that prohibits someone from contacting, harassing, or harming another person. It is intended to protect victims of abuse, harassment, threats, or stalking. The order may also include other provisions, such as requiring the restrained party to stay a certain distance away from the protected person or not come within a certain distance of their home, workplace, or school.

Who Qualifies For A Restraining Order?

Restraining orders are typically issued to victims of abuse, harassment, threats, or stalking by someone they have a close relationship with, such as a spouse, family member, roommate, or intimate partner. However, the criteria for obtaining a restraining order may vary depending on the state and the circumstances of the case.

Types Of Restraining Orders

In most states, there are two types of restraining orders: temporary and permanent.

Temporary Restraining Orders: A temporary restraining order (TRO) is issued by a court to provide immediate protection to someone who needs assistance. It can be issued without the knowledge of the restrained party and is effective for a limited time, typically until a hearing is scheduled to determine if a permanent restraining order is necessary.

Permanent Restraining Orders: A permanent restraining order (PRO) is issued after a hearing in which both parties have had an opportunity to present evidence and arguments.
