The Voluntary Acknowledgment Process: Timelines & Limits

Once a Voluntary Acknowledgment of Parentage is filed, the child’s birth certificate is issued or amended to reflect the added parent. That document carries real legal weight, so Massachusetts law builds in a correction window. Either parent has 60 days after signing to ask the Probate and Family Court to rescind the acknowledgment by filing a complaint.

After those 60 days pass, the window to challenge narrows sharply. A challenge is only permitted within one year of signing, and only on the specific grounds of fraud, duress, or a material mistake of fact. Understanding these deadlines before you sign is one reason it matters to speak with an attorney first.

What Parentage Establishes Under Massachusetts Law

Once parentage is legally established, either parent can ask the court for a custody order or a parenting time schedule if they can’t reach an agreement on their own. Child support follows the Massachusetts child support guidelines and applies regardless of whether the parents were ever married.

The Massachusetts Parentage Act uses inclusive language and addresses parentage rights across a range of family structures, including families formed through assisted reproduction.
